On or after December 5, 2023, the City of Orlando will submit a request to the U.S. Department of Housing and Urban Development (HUD) Program Office for the release of program funds under Title II of the Cranston Gonzales National Affordable Housing Act, as amended, and Title 1 of the Housing and Community Development Act (HCDC) of 1974, as amended, to undertake the project listed below with City of Orlando Community Development Block Grant (CDBG) funding (B-23-MC-12-0015).
Project:
CDBG funds in the amount of $149,946 will be used to replace 14 air conditioning units, throughout the Primrose Adult Day Training campus located at 2733 South Fern Creek Avenue, Orlando, Orange County, FL 32806. The current air-conditioning units have exceeded their useful life, and several are out of service. The CDBG grant will allow the agency to remove the old equipment; flush and treat existing condensate drain; flush and treat existing refrigerant line; seal, insulate and/or repair return plenum as needed; install float safety switch; install new digital thermostat and configure to equipment type; start system and balance to proper specs. The agency proposes to serve 205 I/DD adults in 3 programs.
The activity proposed is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. The Environmental Review Record (ERR) that documents the environmental determination for this project is on file at Orlando City Hall, 7th Floor, 400 South Orange Avenue, Orlando, FL 32801, where it can be reviewed, examined or copied, weekdays, 8 A.M. to 5 P.M., or at: hudexchange.info/programs/environmental-review/environmental-review-records.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Orlando Housing and Community Development Department. All comments received by December 4, 2023, will be considered by the City of Orlando prior to authorizing submission of a request for release of funds.
ENVIRONMENTAL CERTIFICATION
The City of Orlando certifies to HUD that Buddy Dyer, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Orlando to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Orlando’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Orlando; (b) the City of Orlando has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed with attention to Larry T. Hayes (larry.t.hayes@hud.gov), CPD Director, U.S. Department of Housing and Urban Development (HUD), Charles East Bennett Federal Building, 400 W. Bay Street, Suite 1015, Jacksonville, FL, 32202. Potential objectors should contact the HUD office via email at tonya.r.madison@hud.gov to verify the actual last day of the objection period.
